Colorado Co-Owner Property Buyout & Closing Services

When one Colorado property owner wants to keep the home and another wants to leave, a buyout needs more than an agreed price. The documents and closing process must address the ownership interest, payment, existing debt and the timing of deed delivery. ColoradoTitle considers agreed co-owner buyouts for attorney-managed closing and escrow services, subject to review and a written engagement.

What a buyout needs to accomplish

A buyout transfers the departing owner’s interest to the remaining owner for the agreed consideration. Start with the current recorded deed and legal description, rather than assuming ownership shares from who paid the bills. Confirm whether the property is held in joint tenancy, tenancy in common, a trust or an entity. Unequal contributions and disputed ownership require individual legal review.

Agree on the economics before preparing the deed

Document how the parties arrived at the price, whether an appraisal is needed, the loan payoff, any agreed expense credits, and who pays closing costs. Property value minus debt is only a starting point. It does not automatically settle claims about down payments, improvements, occupancy or reimbursement. Confirm what happens if refinancing or another closing condition fails.

Coordinate the agreement, funds and deed

The written agreement should identify the interest conveyed, deed type, payment method, closing conditions, possession date and any releases. Written escrow instructions should state who controls the signed deed, what evidence establishes funding, when documents may be delivered and recorded, and when proceeds may be disbursed. A notarized signature alone does not establish that payment has been received.

Resolve mortgage responsibility separately

A deed does not remove a borrower from a promissory note. Determine whether the existing loan will be paid off, refinanced, or assumed with an express lender-approved release. A promise between owners to make the payments does not bind the lender. Address lender consent and any due-on-sale issue before closing.

How ColoradoTitle can help

Depending on the engagement, work can include documenting jointly agreed terms, coordinating title and payoff information, preparing transfer documents, administering written-instruction escrow, and coordinating signing, recording and disbursement. ColoradoTitle does not issue title insurance; policies are coordinated through a licensed provider. Under a neutral closing engagement, the attorney represents neither owner. Contested negotiations may require separate counsel and a different closing arrangement.

Fees and information for an initial discussion

The existing comprehensive neutral closing service starts at $4,500; this is not an automatic quote for every buyout. Scope and fees require review. Title premiums, recording charges, lender costs, taxes and other third-party charges are separate. Start with the property location, ownership structure, proposed terms, debt information and target date. Confirm a secure method before sending sensitive records.
